California Consumer Privacy Rights

This notice provides information about the rights of California residents under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) and how to exercise those rights.

Your Rights Under California Law

If you are a California resident, you have the following rights with respect to your personal information:

1. Right to Know

You have the right to request that we disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months, including:

  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information is collected;
  • The business or commercial purpose for collecting, selling, or sharing your personal information;
  • The categories of third parties with whom we share your personal information;
  • The specific pieces of personal information we have collected about you.

2. Right to Delete

You have the right to request that we delete any personal information about you that we have collected from you, subject to certain exceptions.

3. Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.

4. Right to Opt-Out of Sale or Sharing

You have the right to opt-out of the sale or sharing of your personal information by us to third parties. Mahalo Health does not sell or share your personal information as defined by the CCPA/CPRA.

5. Right to Limit Use and Disclosure of Sensitive Personal Information

You have the right to request that we limit our use and disclosure of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer.

6. Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights under the CCPA/CPRA.

How to Exercise Your Rights

To exercise your rights described above, please submit a verifiable consumer request to us by either:

Verification Process

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.

To verify your identity, we may ask you to provide additional information. We will only use this information to verify your identity or authority to make the request.

Authorized Agent

You may designate an authorized agent to make a request on your behalf. To do so, you must provide the authorized agent with written permission to make the request and we may require you to verify your identity directly with us.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding the receipt of your verifiable consumer request. If applicable, our response will also explain the reasons we cannot comply with a request.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Notice of Financial Incentive

Mahalo Health does not offer any financial incentives or price or service differences in exchange for the retention or sale of personal information.

California "Shine the Light" Law

California Civil Code Section 1798.83, known as the "Shine The Light" law, permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
